1. Who we are
Paperbark Kids is operated by Paperbark Kids Pty Ltd (ABN to be confirmed on incorporation), a company registered in New South Wales, Australia. In these terms, “Paperbark Kids”, “we”, “us” and “our” refer to Paperbark Kids Pty Ltd.
Paperbark Kids is a peer-to-peer marketplace where Australian parents can buy and sell pre-loved children’s clothing, toys and equipment. We are not a party to the sale (the contract is between the buyer and the seller), but we facilitate payment, shipping and dispute resolution.
2. Eligibility
- You must be at least 18 years old and resident in Australia.
- You must provide accurate information and keep it up to date.
- Accounts are personal. You are responsible for everything that happens under your account.
3. Using the platform
You agree not to:
- List items that are unsafe, counterfeit, recalled, or prohibited by Australian law.
- Misrepresent an item’s condition, size, brand, or origin.
- Use the platform to harass, defame, or endanger other users.
- Attempt to bypass our fees or complete transactions off-platform.
- Scrape, spider, or otherwise copy listings or user data.
Serious or repeated breaches may result in suspension, removal, and referral to the relevant authorities.
4. Listings and sales
Sellers agree to the Seller Agreement, which sets out the specific rules for listing items, shipping, and payouts.
Prices are displayed in Australian Dollars (AUD) and include any applicable GST where the seller is registered for GST. We charge a flat platform fee of 10% of the sale price (excluding shipping). This fee may change. We’ll give thirty days’ notice of any increase.
5. Payments, escrow and refunds
- All payments are processed by our payments partner (Stripe).
- Funds are held in escrow until the buyer confirms receipt of the item, or the confirmation period elapses.
- Refunds are issued from escrow where an item is not as described, does not arrive, or the sale is cancelled by mutual agreement.
- Nothing in these terms limits your rights under the Australian Consumer Law, which provides non-excludable guarantees to consumers in certain circumstances.
6. Shipping
Sellers ship using a prepaid Sendle label issued by Paperbark Kids. Shipping is the responsibility of the seller until the item is lodged with the carrier. Buyers are responsible for providing an accurate delivery address.
7. Disputes
If something goes wrong, open a dispute from the order page within 7 days of delivery (or the expected delivery date, if the item hasn’t arrived). We’ll review the evidence and issue a decision, which may include a full or partial refund, return, or release of funds.
8. Content you post
You keep ownership of the content you post (photos, descriptions, messages). You grant Paperbark Kids a non-exclusive, royalty-free licence to host, display and promote that content for the purpose of operating the service.
9. Account termination
You can close your account at any time from your account settings. We may suspend or terminate accounts that breach these terms, with notice where reasonable.
10. Liability
Paperbark Kids facilitates transactions but is not the seller. Our liability is limited to the maximum extent permitted by law. Nothing in these terms excludes, restricts or modifies rights under the Australian Consumer Law that cannot be excluded, restricted or modified.
11. Changes to these terms
We may update these terms from time to time. Material changes will be announced by email and on the platform at least thirty days before they take effect.
12. Governing law
These terms are governed by the laws of New South Wales, Australia. The courts of New South Wales have non-exclusive jurisdiction over any dispute.
